Terms of Service

1.Scope and provider

These Terms of Service ("Terms") apply to any use of the Dardania Live mobile app (iOS and Android) and of the websites dardanialive.com and dardanialive.app (together: the "Service").

"We", "us" and "Dardania Live" refer to Dardania Live SH.P.K. "You" and "the user" refer to any person using the Service.

2.Acceptance and minimum age

By downloading, installing, opening or using the Service, you accept these Terms. If you do not agree with them, please do not use the Service.

The app is rated for users aged 13 and above. If you are under 18, you may use the Service only with the consent of a parent or legal guardian. If you are under 13, you may not use the Service and may not create an account.

How we handle your personal data is described in our Privacy Policy, which forms part of our relationship with you.

3.What Dardania Live offers

Dardania Live is a digital guide and directory of venues, businesses, institutions and events in Kosovo and in the diaspora. The Service includes:

• Venue and business listings — cafés, bars, clubs, restaurants, hotels, shopping centres, pastry shops, transport services and other services — organised by city and subcategory.
• Public and institutional places — theatres, museums and galleries, sports infrastructure, tourist and historical sites.
• Kosovo's cultural heritage (monuments, fortresses, mosques, towers, bridges, religious and archaeological sites).
• Cultural events, concerts, performances and municipal activities, with the option to bookmark them, add them to your calendar and receive a reminder one day in advance.
• A diaspora section — Albanian businesses, venues and associations abroad, as well as the embassies and consulates of the Republic of Kosovo with their contact details.
• Supporting functions: search, favourites, maps, direct calling, links to the venue's website and social profiles, and an interface in eight languages.

4.Availability and changes to the service

We aim to keep the Service continuously accessible, but we do not guarantee uninterrupted or error-free availability. The Service may be temporarily unavailable due to maintenance, updates, technical reasons or third-party providers (e.g. servers, networks, app stores).

We reserve the right to change, extend or discontinue features of the Service. Where a substantial change directly affects you, we will try to inform you in advance in the app or by email.

Using the Service requires a suitable device and internet access. Device and data costs are yours to bear.

5.User accounts

Most content can be browsed without an account. An account is needed for features such as sending reservation requests, submitting events or managing a venue.

Registration

When registering, you choose an account type, for example:

• Client / visitor — ordinary use of the app.
• Venue or business in Kosovo — for owners and managers.
• Municipality in Kosovo — for municipal staff.
• Venue, business or association in the diaspora.
• Embassy or consulate of the Republic of Kosovo.

Your obligations

• The information you provide (name, email, phone number, city, business name) must be truthful, complete and kept up to date.
• You must not impersonate another person or claim to represent a business, municipality or institution without authorisation.
• You must keep your password and access credentials confidential and not share them with third parties.
• If you suspect your account has been misused, notify us immediately at info@dardanialive.com.

You are responsible for all activity carried out through your account. An account is personal and may not be transferred to someone else without our consent.

6.Roles and access rights

The Service works with different roles that determine what each user may do: ordinary user, event organiser, venue or business manager, municipal worker, embassy/consulate worker, ministry worker, Dardania Live field agent, administrator and super administrator.

Extended roles are granted only upon request and after review by us. We may refuse a request, restrict a role or withdraw it at any time — in particular where authorisation for the relevant venue or institution is missing, or where a role is misused. No role creates a legal claim to keep it permanently.

Each role applies only within its assigned scope (for example, a venue manager may edit only their own venue; a municipal worker only their own municipality). Deliberately exceeding these limits is a serious breach of these Terms.

7.User-generated content

Users with the relevant roles may upload content such as venue details (name, address, opening hours, phone, description, coordinates), events, photos, flyers and menus. This is referred to as "user content".

You warrant that:

• You are entitled to publish the content and it does not infringe third-party rights (copyright, image rights, trademarks, personality rights).
• The photos you upload are yours or you have permission to use them, and identifiable persons in them have given their consent.
• The venue or event information is accurate and not misleading.

The licence you grant us

By uploading content you grant us a non-exclusive, royalty-free, worldwide licence, transferable to our technical service providers, to store, display, technically adapt (e.g. resize or reformat), translate and distribute that content within the Service, and to use it in Dardania Live's own promotional materials (e.g. on our websites, in the app stores and on social media).

You retain ownership of your content. The licence lasts as long as the content remains in the Service; after deletion we may still retain technical copies in backups, and uses already made in previously distributed materials remain unaffected.

8.Moderation, approval and removal

Some content is reviewed before publication. For example, events submitted by organisers are marked "pending" until the competent administrator approves them, and later edits may require renewed approval. Visual material such as flyers and menus may also be reviewed.

Other content may be published immediately and checked afterwards. In both cases we are entitled to reject, amend or remove content and to deactivate a listing, in particular where it:

• contains inappropriate photos;
• is inaccurate or misleading;
• contains material prohibited by law;
• infringes third-party rights or these Terms.

Where something is rejected, you are notified in the app together with the reason. We are not obliged to pre-screen all content and assume no general monitoring duty. If you come across problematic content, please write to us at info@dardanialive.com.

9.Prohibited use

When using the Service, the following is expressly prohibited:

• publishing false or misleading information or fictitious listings;
• offensive, defamatory, violent, racist, sexual or unlawful content, as well as content inciting hatred;
• infringing copyright, trademarks or other people's privacy;
• spam, unsolicited advertising, bulk messaging or bogus reservation requests;
• manipulating rankings, ratings or statistics, including creating multiple accounts for that purpose;
• unauthorised access to accounts, data or parts of the system, and circumventing technical restrictions;
• automated data extraction (scraping, crawling, harvesting), copying our database or using it to build a competing service, without our prior written permission;
• uploading malicious code or any action that harms the stability, security or operation of the Service;
• using the Service for purposes contrary to applicable law.

In the event of a breach we may remove the content, restrict or block the account and, where necessary, notify the competent authorities.

10.Accuracy of venue and event information

Information about venues, institutions and events comes from the businesses, organisers and institutions themselves, or from public sources. Although we try to keep it current, we do not warrant its accuracy, completeness or timeliness — including opening hours, addresses, phone numbers, prices, menus, availability, dates, venue or the actual staging of an event.

Events may be postponed, changed or cancelled by the organiser without notice. Before travelling, we recommend confirming the information directly with the venue or organiser.

The star value shown for some venues is an editorial reference value maintained by us. It is not a user review system and does not represent an average of public votes.

The app does not sell tickets and does not broker ticket purchases. Any ticket purchase takes place outside the Service, under the respective organiser's terms.

11.Reservation requests

For some venues, where the owner has enabled this option, you may send a reservation request (name, phone, email, party size, date and time, notes). The request is forwarded to the venue, which may approve or reject it; the venue then contacts you directly via WhatsApp, Viber or SMS, according to your chosen preference.

• Sending a request is not a confirmed booking and creates no obligation for the venue.
• Any contract for a table, room or service is concluded solely between you and the venue. Dardania Live is not a contracting party, agent or guarantor.
• We are not liable if the venue does not respond, rejects the request, cancels the booking or does not deliver the service as expected.
• False, prank or bulk requests are prohibited and may lead to your account being blocked.

The contact details you provide in a request are forwarded to the relevant venue so that it can reply to you.

12.Businesses: listings and packages

Venues and businesses may appear on Dardania Live with a basic listing or with a subscription package. The current packages are VIP, Gold, Silver, Bronze and Basic. They mainly affect:

• the position of the listing within its subcategory and city;
• the maximum number of events that may be published per month;
• visual elements of the venue card (e.g. the tier badge).

Top-tier positions are limited per subcategory and city and are allocated in the order in which contracts are concluded. If a position is taken, the business may be placed on another tier until it becomes free. Prices, package contents and limits may change; changes are communicated before they take effect for a new period.

Businesses are themselves responsible for keeping their data accurate and up to date and for holding the permits required for their activity. We may deactivate or remove a listing if the business no longer exists, breaches these Terms or fails to meet its contractual obligations.

13.Contracts and payments outside the app

The app merely records contract and payment status for our internal administration — it does not process payments, does not store card data and offers no in-app purchases. Visitors pay nothing.

Subscription periods are quarterly or annual (with a discount for annual payment), as set out in the individual contract. A tax invoice including VAT is issued by Dardania Live SH.P.K. for each payment. Detailed terms — duration, price, notice period and refund rules — are set out in the signed contract itself. In case of conflict between an individual contract and these Terms, the signed contract prevails for the relationship with that business.

14.Advertising

The Service may display advertising slots (banners or short videos) on the home screen, in category lists and in the diaspora section. Advertisements are time-limited and may be shown only for selected cities.

Advertisements are placed by us alone. Responsibility for the content of an advertisement and for the offer behind it lies with the advertiser. Clicking an advertisement may take you to an external page, for which section 16 applies.

The app does not use third-party advertising networks to track your behaviour across other apps; details are set out in the Privacy Policy.

15.Intellectual property

The name and brand "Dardania Live", the logo, the design, icons, editorial texts, photos produced by us, the source code and the database structure are protected and belong to Dardania Live SH.P.K. or its licensors.

You are granted a personal, non-exclusive and revocable right to use the app for its intended purpose. Without our prior written consent you may not:

• copy, distribute or republish our content outside the Service;
• use the brand or logo in your own materials;
• disassemble, decompile or modify the app, except where the law expressly permits it;
• systematically extract or re-use data from our directory.

Names and logos of venues, businesses and institutions belong to their respective owners and are shown for information purposes.

16.Third-party links and services

The Service contains links and connections to third-party offerings, such as venue websites, social media profiles, phone numbers, messaging apps (WhatsApp, Viber, SMS) and map services (Google Maps, Apple Maps).

This content is not ours. We have no influence over it and accept no responsibility for its accuracy, lawfulness or availability. When you use it, the terms and privacy policies of those providers apply.

17.Limitation of liability

The Service is provided "as is" and "as available". To the extent permitted by law, we give no warranty that the Service is fit for a particular purpose, operates without interruption or error, or that content uploaded by users or taken from public sources is accurate.

In particular, we are not liable for:

• damage arising from reliance on inaccurate venue or event information (opening hours, price, address, date);
• the cancellation, alteration or quality of an event or a third-party service;
• a reservation not materialising, or disputes between you and a venue;
• data loss, technical outages or damage caused by third-party providers;
• the content of external websites.

We are liable without limitation only for damage caused intentionally or by gross negligence, and in other cases where liability is mandatory under the law of the Republic of Kosovo — including injury to life, body or health. Mandatory consumer rights are not affected by these Terms.

If third parties bring claims against us because of content you uploaded or because you breached these Terms, you agree to defend us and to reimburse the reasonable costs arising from such claims.

18.Termination and account deletion

You may stop using the Service at any time: simply uninstall the app, or delete your account using the "Delete Account" function in the app's Settings. You can also send the request by email to info@dardanialive.com.

We may suspend or delete an account if these Terms or the law are breached, if the account is misused, if the information given is false, or if the account has remained unused for a long time. For minor breaches we will notify you in advance where this is reasonable.

After an account is deleted, published venue listings and events may remain in the Service as informational directory content, provided they refer to businesses or activities that still exist. Contractual relationships with businesses end according to the signed contract. Deletion of personal data is governed by the Privacy Policy.

19.Changes to these terms

We may update these Terms, for example when new features are added or the legal situation changes. The current version is always published on this page, with the update date shown at the top.

For substantial changes we will notify you in the app or by email. If you continue to use the Service after the changes take effect, you are deemed to have accepted them. If you do not agree, you may stop using the Service and delete your account.

20.Governing law and jurisdiction

These Terms and any relationship arising from them are governed by the law of the Republic of Kosovo.

The courts of the Republic of Kosovo, at the registered seat of Dardania Live SH.P.K., have jurisdiction over disputes. If you are a consumer and the law of your country of residence grants you mandatory protection or a mandatory place of jurisdiction, those rights remain unaffected.

If any provision of these Terms is invalid, the remaining provisions stay in force. The invalid provision is replaced by the statutory rule that comes closest to its purpose.
